EAD Expedite Rejection
I wanted to share my experience, although not good it may be of some use to someone.

I got my EAD in October but it expired within 2 months due to the DS-2019 expiring. I work in philanthropy for a public research university and tried to use this as an expedite criterion which was rejected. It was rejected again after I asked my congresswoman's office to follow up.

Now I'm waiting. I don't regret trying, but after speaking with 2 lawyers they have both advised that it's extremely rare, and that normally the expedite decision is based on extreme emergent situations, such as humanitarian reasons. Just because you meet one of the expedite criteria listed, it doesn't mean you will get the expedition. Meeting on of the criteria is a requisite for USCIS to even consider expediting your case.

Reading about others' positive expedite experiences can give us the impression that expedites (especially when politicians are involved) are an easy route to faster adjudication. I found out the hard way that they're not. Doesn't mean you shouldn't try but this is to manage anyone's expectations who does try.

Hi,

My sister got F1 visa on Arkansas University. But she transferred for that university to wilmington university through online process. Recently she completed her masters. When she applied Opt card, she got a mail stating to provide additional evidence. She was asked to submit proof of tuition payment made to Arkansas University, a copy of student identification card at Arkansas University...etc. Thing is she did not attended Arkansas university. So how to proceed. Help me.

Thank you.

updated your name for your Form I-765, for EAD
Hi every one,

the status of my application changed to "On February 14, 2016, we updated your name for your Form I-765, Application for Employment Authorization". Does any one knows what does this mean ? Does this mean I might have made some mistake on the form (which is unlikely as I checked number of times )

Thanks

EAD processing time / timeframe (Approved in 113 days)
EAD through U.S. spouse (I-485, I-130)
Submitted documents to Chicago Center, but receipt numbers had MSC. Don’t know if that means it is Missouri taking care of my case.

Here I summarize what I would recommend to people applying for an EAD. It is a long and stressful process and experiences seems to be different from case to case, but maybe this will help some of you that are in a similar situation.

- Submit I-765 together with 485 and 130 even if you don’t have a job offer or are not planning to work. Better to get the process started so that the days start counting.

- Create an account online and sign up for Case Updates so that you get emails and/or Text messages when you case is updated. No need to login to check the status.

- If you get a job offer, try to ask you congressman to expedite the process, no matter what day you are in. In my case I expedited it myself through Customer Support on day 30 and they agreed to expedite it. However, nothing happen to my case! It remained unanswered. The response I got for the expedite request came in an email, not an official letter, so there was no official record of this approval and did not become part of the case history. When I asked support what it meant to have it expedited, they told me it would take “less” than 90 days, which at the end didn’t.

- Create Service Requests on day 75 and 90. I did the first one over the phone and the second one myself online. The response was the same and it came a day or two after. Counting the days if you have RFEs is unclear how it works, I found references that said that the count stop/resume and another one saying that it starts over [1] [2]. My 765 case did not have a direct RFE (my 485 did have) and Customer Support said that the days could be counted from the beginning without interruption.

- Over day 90? Definitely get your local congressman involved. They are willing to help. Make sure you keep in touch with the congressman representative to hear the answer. I’m sure they have a lot of cases and they can’t keep track of all emails they get. Also, you have the possibility to create an infopass appointment, most people say that it is useless but, at least, it is something you can do.

- Finally, if possible assume that the case will take 120 days and take action after day 75. Otherwise, you will spend the first 90 days being stressed out over not knowing what’s happening with your case and hoping it will be approved any day.

And my timeline is:
10/05 Sent envelope
10/08 USCIS Envelope received (Priority date)
10/16 Update: Received SMS with Receipt Number / Checks cashed (8 days)
10/19 Mail: Received Mail confirmation (11 days)
10/19 Sent application for EAD
10/20 Update: USCIS received EAD application
10/23 Mail: Received letter for Biometrics appointment. (15 days)
11/03 Biometrics appointment (26 days)
11/05 Request to expedite EAD, response the same day (28 days)
11/06 Sent Job Offer letter (29 days)
11/09 Expedite processing approved. "Documentation submitted meets the requirements for expedite processing of your application/petition. Your case is currently under review. You will receive a decision or notice of further action shortly.” (32 days)
11/23 Email: Received RFE notice by email (46 days)
11/27 Mail: Received RFE by post (50 days)
12/01 Sent mail with RFE, received next day by USCIS
12/03 Email: USCIS email response on received RFE (56 days)
01/04 Day 75 - Created Service Request over the phone
01/06 Update: SR was answered according to case history
01/11 Mail: SR response by mail
01/20 Day 93 - Created service request online
01/21 Email: Received email with online SR response.
01/21 Contacted congressman to request help
01/22 Sent documents to congressman
02/05 Received answer from congressman. Requested letter from company.
02/08 Sent company letter to Congressman
02/10 Received notification from USCIS that the EAD case had been approved (113 days)
02/11 Update: Card has been mailed
02/13 Mail: Received EAD card (116 days). It came in a priority envelope but I didn’t get the tracking number from USCIS.

Good luck to everyone.

L2 EAD Renewal - 118 days!!
L2 EAD renewal, Nebraska

16th Oct 2015 - Attorney Mailed application to USCIS (exactly 120days before expiry of current card)

16th October 2015 - USCIS Received:

29th October 2015 - USCIS Receipt received by mail: (Receipt Date 20th October 2015)
No Biometrics (not needed)
No change in status for 75 days.

4th Jan 2016 – 79th day Attorney raised online SR (holidays..grr!)
12the Jan 2016 - Generic response by mail. Inline to be received by officer

15th Jan 2016- 91st day - Attorney sent email inquiry. No response for 7 days

26th Jan - I raised phone enquiry
29th Jan- Generic response for phone inquiry email: Pending adjudication, additional
reviews are being performed

29th Jan - Attorney raised expedite request (employer letter, employer notice, personal letter). Attorney clearly told expedite request may not work. But we were running out of options.

3rd Feb - Response: Expedite Request received, even if accepted there may be RFE or Security check …Scary. Took infopass appointment, but available slot was very close to expiry date

3rd Feb – I personally contacted Congress reps office with all details.

5th Feb - Attorney and Congress office got email that card was approved and being produced! But online case status was still Case Received.

8th Feb - attorney emailed USCIS as to why status was still Case Received. Got response that online status is lagging but confirmed that card is in production.

9th Feb status changed to Card mailed

11th Feb card delivered…2 days to expiry. phew! (it’s scary when they say it might take 30days to receive card after mailing…I mean as if we haven’t gone through enough)

118 days from application to get card in hand.

The anxiousness, the mental strain is too much. You end up checking the status every half hour. It’s also troubling that your case only gets attention after 90days and there are chances of RFE and also I read on this forum about validity of photographs. That’s insane. It’s amazing how contacting the Congress reps office resolves the issue. I suggest that on 91st day try InfoPass (may not be helpful, but shows you tried everything) appointment and in parallel contact Congress reps office.
