H1 Visa Overview

The H-1B visa category remains one of the most widely used and lawful pathways for U.S. employers to temporarily employ foreign professionals in specialty occupations. The program enables U.S. companies to access highly skilled global talent while maintaining compliance with U.S. immigration regulations. 

H-1B Validity Period and Extensions 

An individual may generally work in H-1B status for a maximum of six years.

  • Initial approval: up to 3 years 
  • Extension: additional up to 3 years 
  • Standard maximum stay: 6 years 

Certain foreign nationals working on qualifying U.S. Department of Defense cooperative research projects may remain in H-1B status for up to 10 years. 

Extensions Beyond Six Years (AC21 Provisions) 

Due to immigrant visa backlogs, many H-1B workers qualify for extensions beyond six years under AC21: 

  • 1-year extensions: available when a PERM Labor Certification or I-140 immigrant petition has been pending for at least 365 days. 
  • 3-year extensions: available when an I-140 petition is approved but the priority date is not current. 

Recent USCIS Modernization and Policy Updates

Electronic Registration System

USCIS continues to use an electronic registration process for cap-subject H-1B filings with recent improvements: 

  • Beneficiary-centric lottery selection 
  • Reduced duplicate registrations 
  • Increased fraud detection and compliance review 

Specialty Occupation Standards

USCIS emphasizes that:

  • The position must normally require a bachelor’s degree or higher in a specific specialty. 
  • The degree field must directly relate to job duties. 
  • Third-party placements require detailed documentation, contracts, and work orders. 

Compliance and Site Visits

Employers should expect continued worksite inspections and must maintain:

  • Accurate job locations 
  • Proper LCA postings 
  • Prevailing wage compliance

Employer Sponsorship Requirement

An H-1B petition must be filed by a U.S. employer. Individuals cannot self-petition. 

Self-employment is generally not permitted unless a legitimate employer-employee relationship exists, demonstrating the employer’s right to control the worker’s employment. 

Consulting or staffing companies may sponsor employees placed at client sites if regulatory requirements are satisfied. 

Dual Intent Benefit

The H-1B classification allows dual intent, meaning a foreign national may: 

  • Work temporarily in the United States 
  • Simultaneously pursue permanent residence (green card)

Filing a labor certification or immigrant petition does not negatively affect H-1B or H-4 status or visa issuance. 

H-1B/H-4 holders may travel internationally using valid visas even while a green card application is pending.

Family Members – H-4 Status and H-4 EAD

Spouses and unmarried children under age 21 of H-1B workers may accompany or follow to join under H-4 dependent status.

H-4 Employment Authorization (H-4 EAD)

Certain H-4 spouses are eligible to work in the United States by applying for an Employment Authorization Document (EAD). 

An H-4 spouse may apply for work authorization if either of the following conditions is met:

  • The H-1B principal has an approved I-140 immigrant petition. 
  • The H-1B worker has received H-1B extensions beyond six years under AC21 provisions.

  • Allows employment with any U.S. employer 
  • Permits full-time, part-time, remote, or multiple jobs 
  • Allows self-employment, freelancing, or business ownership 
  • No prevailing wage or sponsorship requirement 
  • Validity typically matches the H-4 status period

Recent Processing Improvements

Recent USCIS procedural updates allow certain H-4 and H-4 EAD applications filed together with an H-1B extension to be adjudicated more efficiently, helping reduce employment gaps for dependent spouses. 

However, processing times may still vary depending on USCIS workload and service center operations.

Employment Flexibility and Multiple Employers

H-1B workers may work for multiple employers simultaneously (concurrent H-1B employment), but each employer must file a separate petition.

Change of Employer (H-1B Portability)

Under portability rules:

  • Employment with a new employer may begin once USCIS receives a properly filed H-1B transfer petition. 
  • Approval is not required before starting new employment, provided a valid status is maintained.

Termination and Employer Obligations

If employment ends before the approved validity period: 

The employer must offer reasonable return transportation costs to the employee’s last country of residence. 

A 60-day grace period (or until I-94 expiration, whichever is earlier) is generally available to:

H-1B workers may:

  • Work only for sponsoring employer(s) 
  • Buy real estate in the United States 
  • Invest in stocks, mutual funds, or businesses (passive investments) 

H-1B workers may not:

  • Freelance or perform unauthorized work 
  • Be self-employed without proper sponsorship

Travel and Visa Processing

  • Individuals inside the U.S. may request change of status to H-1B. 
  • Individuals outside the U.S. must obtain an H-1B visa stamp after petition approval. 
  • Consular processing may involve administrative review depending on background checks.
